Justice constitutes an essential pillar of the democratic rule of law, ensuring not only the repression of criminal activity but, above all, the prevention of violations of fundamental rights and the promotion of security and social cohesion. According to the core principles of justice policy, it should be articulated with other areas of public intervention — such as education, health, social protection, and housing — contributing to integrated policies that address risk factors and the root causes of social exclusion and conflict.

The justice sector therefore plays a decisive role not only in protecting victims and holding offenders accountable but also in building a fairer, more inclusive, and safer society through preventive, reparative, and reintegration-oriented actions aimed at full social inclusion.

In the context of children and youth, this mission is implemented through custodial and protective measures applied by courts, child protection commissions, and other competent bodies, which should prioritise preventive or early intervention responses that are multidisciplinary and centred on the best interests of the child, placing the child at the heart of decision-making.

At the same time, significant challenges persist in the penal system, including prison overcrowding and the continued presence of dozens of young people in Educational Centres — many of whom had previously been identified in at-risk contexts. This situation highlights the need for intersectoral public policies that promote safer, more opportunity-rich, and inclusive life trajectories.

It is therefore essential to encourage the development of social innovation projects that, in an integrated and territorially adapted manner, engage early with vulnerable young people and adults, preventing deviant behaviours, strengthening personal and social skills, and breaking cycles of exclusion and criminal recidivism.

Public Policy Priorities

Within the framework of the financing instruments managed by Portugal Inovação Social – Social Impact Bonds and Social Impact Contracts – the public entities responsible for implementing sectoral policy have identified priority public policy themes for the development of social innovation and entrepreneurship projects that address social issues based on outcomes or verified public expenditure savings.
